These Terms of Service ("Terms") govern your access to and use of MyLearnEngine's AI-powered learning platform (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By creating an account or using any part of the Service, you confirm that:

  • You are at least 13 years of age (or the minimum age required in your jurisdiction)
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • All information you provide is accurate and up-to-date

2. Description of Service

MyLearnEngine provides an AI-powered learning platform that enables users to:

  • Create personalized learning sessions on various topics
  • Engage in interactive AI-driven conversations and explanations
  • Generate and review flashcards and knowledge tests
  • Track learning progress and study metrics
  • Access learning materials across multiple devices

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with or without notice.

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

3.2 Account Termination

4. Subscription Plans and Billing

4.1 Free and Paid Plans

MyLearnEngine offers both free and paid subscription plans with different feature limits. Current plans include:

  • Free Plan: Limited learning sessions and features
  • Basic Plan: Enhanced limits and additional features
  • Pro Plan: Unlimited access to all platform features

4.2 Payment Terms

For paid subscriptions:

  • Subscriptions are billed monthly or annually based on your selected plan
  • Payment is processed through Stripe, our secure payment provider
  • All fees are non-refundable except as required by law
  • Subscriptions automatically renew unless cancelled before the renewal date
  • We reserve the right to change pricing with 30 days notice

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • You will retain access until the end of your current billing period
  • No refunds will be provided for partial billing periods
  • Your account will revert to the Free plan at the end of the period

5. Acceptable Use Policy

When using the Service, you agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights of others
  • Transmit harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to the Service or systems
  • Use automated systems to access the Service without permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Share your account credentials with others
  • Use the Service for any commercial purpose without authorization
  • Interfere with or disrupt the Service or servers
  • Create multiple accounts to circumvent usage limits

6. Intellectual Property Rights

6.1 Our Content

The Service, including its software, design, text, graphics, and other content (excluding User Content), is owned by MyLearnEngine and protected by copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain ownership of any content you create or input into the Service ("User Content"). By using the Service, you grant us a limited license to:

  • Store, process, and display your User Content to provide the Service
  • Use your learning data to improve AI models and Service features (in anonymized form)
  • Create backups and ensure Service security and functionality

6.3 AI-Generated Content

Content generated by our AI (explanations, flashcards, questions) is provided to you for your personal learning use. You may not:

  • Republish or redistribute AI-generated content commercially
  • Use AI-generated content to train competing AI models
  • Remove attribution or claim AI-generated content as your own work

7. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate educational content. Please be aware that:

  • AI-generated content may contain errors, inaccuracies, or outdated information
  • Content should not be relied upon as professional, medical, legal, or financial advice
  • You should verify important information through authoritative sources
  • AI responses are generated based on patterns and may not reflect current events or specialized knowledge

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, MyLearnEngine disclaims all warranties, including:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties regarding accuracy, reliability, or completeness of content
  • Warranties that the Service will be uninterrupted, secure, or error-free
  • Warranties regarding the results obtained from using the Service

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYLEARNENGINE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

In no event shall our total liability exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless MyLearnEngine, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your User Content

12. Third-Party Services

The Service may integrate with third-party services (such as payment processors, AI providers, analytics tools). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services or content.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes:

  • We will update the "Last updated" date at the top of this page
  • We will notify you via email or Service notification for material changes
  • Your continued use of the Service after changes constitutes acceptance
  • If you do not agree to changes, you must stop using the Service

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for:

  • Violation of these Terms or applicable laws
  • Suspicious or fraudulent activity
  • Extended periods of inactivity
  • Requests by law enforcement or government agencies

Upon termination, your right to access the Service will immediately cease. Provisions that should survive termination will remain in effect.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where MyLearnEngine operates, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You agree to waive your right to a jury trial or to participate in class actions.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to reflect the parties' intention to the greatest extent permitted by law.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyLearnEngine regarding the Service and supersede all prior agreements and understandings.
